Terms for package tours
The agreement
The agreement is binding for the parties once the organiser has confirmed in writing the traveller’s booking. The organiser shall confirm the traveller’s booking without delay. The right of withdrawal does not apply to agreements for the purchase of package tours.
The main traveller is the person in whose name the agreement has been made. The main traveller is responsible for the payment in accordance with the agreement. All changes and cancellations must be made by the main traveller with the exception of cases in which the main traveller becomes seriously ill and is unable to carry out the change or cancellation. The main traveller is responsible for providing the organiser with the correct booking details for the other travellers covered by the agreement. Any repayments will be made to the main traveller.
The main traveller is responsible for forwarding all information from the organiser and its subcontractors to all travellers.
In making the booking the main traveller confirms that all travellers covered by the booking are over 18 years of age or have the permission of their guardian.
Travel services are only included in the package tour agreement if they were booked together with and at the same time as the services included in the package tour or if the travel services were sold by the organiser in combination with other services for a total price.
Any special services or wishes provided at the traveller’s request are only included in the agreement if expressly communicated in writing by the organiser.
The traveller is responsible for checking the booking confirmation and other documents as soon as they are received and ensuring all the details are correct. Any errors must be communicated at the earliest possible time. The organiser has the right to charge for the actual cost of correcting erroneous information as well as reasonable remuneration for the additional work that the correction entails. If the error is the fault of the organiser or one of its employees, the correction shall be made without cost to the traveller.
The main traveller shall continue to communicate to the organiser any changes to his/her details that affect the organiser’s ability to contact the traveller.
The organiser or its subcontractors may provide specific instructions or terms for travel services included in the package tour, e.g. with regard to safety or liability.
Price and payment
The total price of the package tour is indicated by the confirmation. The traveller shall pay the entire cost of the package tour according to the terms stated in the confirmation.
If the traveller does not pay the price of the tour in accordance with the agreement, the organiser maintains the right to cancel the agreement and claim reasonable compensation.
If not otherwise stated explicitly, the price of the tour is based on accommodation for two persons in a shared double room. The organiser maintains the right to add a surcharge for accommodation for a single person in a double room or larger room intended for more than one occupant.
Traveller’s rights to changes and cancellations
The traveller has the right to make changes to the agreement with the organiser’s consent. Changes to the agreement may result in additional costs for the traveller from the organiser or others. Changes to the agreement may in some cases involve cancelling an agreed service and making a new booking for another service, which may result in additional costs for the traveller. In the case of changes made at the traveller’s request, the organiser maintains the right to charge an administrative fee.
The traveller has the right to cancel the booking. The organiser maintains the right to charge a cancellation fee.
Specific cancellation fees may apply to services included in the package tour. In that case, these are stated in the booking confirmation. If not otherwise stated in the booking confirmation, the following cancellation rules apply:
Cancellations made more than 48 hours prior to arrival will not incur a cancellation fee. Cancellations made within 48 hours of arrival will incur a cancellation fee of 100% of the price of the booking.
Traveller’s rights to transfer the agreement
The traveller may transfer the agreement to someone who meets all the requirements for inclusion in the booking. The traveller must inform the organiser of the transfer within a reasonable time prior to departure. The organiser may charge a reasonable fee for the transfer.
The transferrer and receiver of the agreement are mutually responsible to the organiser for any outstanding payment associated with the booking and any extra costs incurred as a result of the transfer.
Changes prior to departure
- Changes to the terms of the agreement
The organiser has the right to make changes to the agreement provided the organiser informs the traveller of the change in a clear and understandable way. If the change is insignificant, the traveller does not have the right to a price deduction or damages. In the case of fundamental changes to the tour, the traveller shall, if possible, be offered an alternative or the right to cancel the agreement without a cancellation fee.
- Traveller’s right to cancel the agreement without a cancellation fee
If the traveller wishes to cancel the agreement on the basis of a fundamental change, the traveller must inform the organiser of his/her decision to cancel the agreement within a reasonable time of being informed of the change by the organiser. If the traveller does not do this, he/she will be bound by the new agreement.
- Organiser’s and traveller’s rights to cancel the agreement in the case of unavoidable and extraordinary events
Both the organiser and the traveller have the right to cancel the agreement if the implementation of the package tour is significantly affected by unavoidable and extraordinary events at the destination or its immediate surroundings. Unavoidable and extraordinary events include, for example, serious safety issues such as those caused by war, terrorism, the outbreak of a serious disease or natural disasters. In this case, the traveller has the right to cancel the agreement without paying any cancellation fee. If the organiser cancels the agreement as a result of the above, the traveller has no right to damages.
The traveller does not have the right to cancel the agreement on the grounds of unavoidable or extraordinary events of which he/she was aware at the time the agreement was entered.
Organiser’s responsibility for fulfilling the booking
- Changes as a result of circumstances outside the organiser’s control
The organiser has the right to change the logistics, departure and arrival times and programme content as a result of circumstances outside the supplier’s control, for example, delays or changes to transportation or weather conditions that make it difficult or impossible to go ahead with the arrangements safely or practically. Such changes shall be quickly communicated to the traveller and, where applicable, replaced with programme content that is as similar as possible to that in the agreement.
The traveller has the right to a reduction in price if the arrangement provided has a lower value than the one that was agreed on. The traveller does not have the right to a reduction in price if the change occurs as a result of the traveller or any situation for which he/she is responsible. In this case, the traveller also has no right to damages.
If a travel service is not implemented in accordance with the agreement, the organiser shall remedy the error in a reasonable time. However, the organiser is not responsible for remedying the error if it is impossible or would result in disproportionate costs. If the organiser does not remedy the error, the traveller has the right to a price reduction and damages.
If after departure a fundamental part of the agreed-upon services cannot be fulfilled, the organiser shall, if possible, arrange an alternative of equal value at no extra cost to the traveller. If the organiser cannot offer this, the organiser shall offer an alternative of lower quality in combination with a reasonable price reduction. The traveller may only reject such alternatives if these cannot be considered comparable to the services that should have been offered in the agreement or if the offered price reduction cannot be seen as reasonable.
If the organiser does not offer an alternative or if the traveller has the right to reject such an alternative, the traveller may have the right to a price reduction and damages.
About price reductions and damages
Price reductions are not granted if an error is the result of the traveller.
The traveller has no right to damages if the organiser can demonstrate that the error is the result of the traveller or a third party that is unconnected to the provider of travel services included in the package tour, or if the error is the result of unavoidable and extraordinary events.
The traveller is responsible for limiting the damage as far as possible.
If there is no other limitations imposed by the Package Tour Law or other mandatory legislation, the organiser’s liability for damages is limited to three times the cost of the package tour. However, this limit does not apply in the case of personal injury or as a result of intention or negligence.
Complaints
The traveller may only raise errors in the agreed services if he/she notifies the organiser of the error within a reasonable time after he/she has or ought to have noticed the error. This should be done as soon as possible and, if possible, on location. When determining any price reduction or compensation for damages, consideration will be given to the time when the traveller complained if such a message would have allowed the organiser to remedy the error.
The traveller’s responsibilities
The traveller is responsible for following the instructions for the implementation of the tour as provided by the organiser or anyone it hires. The traveller is responsible for respecting the regulations and safety instructions of the tour and travel services included in the tour and for behaving in a way that does not impinge on fellow travellers or others. If the traveller breaks these conditions in a fundamental way, the organiser may cancel the agreement without the traveller being entitled to compensation or a refund.
- The traveller’s responsibility for damages
The traveller is responsible for any damages caused to the organiser or its subcontractors as a result of his/her negligence.
- The traveller’s responsibility for formalities
The traveller is responsible for following the information provided by the organiser.
Disputes
Disputes arising from this agreement shall be settled by a public court through the application of Swedish law. Consumers may also direct disputes to the National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, Sweden, www.arn.se, or the EU Commission’s online platform: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=EN to have the dispute tried.
